END USER LICENSE AGREEMENT (EULA) FOR THE CURA APP

This End User License Agreement (the “Agreement”) is a legal agreement between you

(the “User”) and Phar-Med Consulting (PhMC) Pharmacy Inc. located in Central

California, USA corporation (“Company,” “we,” “us,” or “our”) governing the use of The Cura App (the “App”). By installing, accessing, or using the App, you agree to be bound by the terms and conditions of this Agreement.

LICENSE GRANT:

1.1 License Scope: Subject to the terms of this Agreement, Company grants the User a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

1.2 Restrictions: The User shall not, and shall not permit others to: (a) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App; (b) use the App for any purpose that is illegal or prohibited by this Agreement; (c) rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App to any third party; (d) remove, disable, circumvent, or otherwise create or implement any workaround to any copy protection, rights management, or security features in or protecting the App.

INTELLECTUAL PROPERTY:

2.1 Ownership: The App is licensed, not sold. Company retains all rights, title, and interest in and to the App, including all intellectual property rights.

2.2 Third-Party Content: The App may include third-party content. The User acknowledges and agrees that such third-party content is subject to the respective third-party terms and conditions.

TERMINATION:

4.2 Effect of Termination: Upon termination, the User must cease all use of the App, and all licenses granted under this Agreement shall immediately terminate.

5.1 AS-IS BASIS: THE APP IS PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY

LIMITATION OF LIABILITY:

Any attempt to work independently or facilitate transactions without utilizing the App’s services is considered a violation of our terms. This includes but is not limited to:

      Direct Transactions: Users and service providers cannot engage in direct transactions, agreements, or services outside of The Cura App.

      Independent Work: Users and service providers are not permitted to independently provide or seek services that are typically facilitated through The Cura App.

      Payment Bypass: Users and service providers must complete all transactions and payments through The Cura App. Bypassing the app’s payment system for services rendered is strictly prohibited.

      Unauthorized Agreements: Any attempt to establish agreements, transactions, or interactions outside of The Cura App’s features and services is against our terms of service.

Consequences of Violation:

Engaging in prohibited activities may result in account suspension, termination, and legal action. The Cura app service provider/chaperone/driver is not permitted to engage in any business interactions with the guest/service user outside of the Cura app without obtaining explicit approval from Cura. Any direct business transactions or engagements outside of the app without Cura’s approval are strictly prohibited. Cura app holds the right to act as a beneficiary of any businesses that may arise as a result of connections made through the app.
